What Is Hemp-Derived Delta-9 THC?
Delta-9 THC is a naturally occurring cannabinoid found in both hemp and marijuana plants. It is the primary cannabinoid responsible for the traditional psychoactive effects associated with cannabis.
Under the 2018 Farm Bill, hemp is federally defined as cannabis containing no more than 0.3% Delta-9 THC by dry weight. Products derived from legally grown hemp that remain within this limit may be federally compliant, although individual state laws can differ.
Because the legal threshold is based on percentage by dry weight—not the total amount of THC in a product—properly formulated hemp-derived products such as gummies can legally contain meaningful amounts of Delta-9 THC while remaining Farm Bill compliant.
What Is THCA?
THCA (tetrahydrocannabinolic acid) is the natural precursor to Delta-9 THC. In freshly harvested cannabis and hemp plants, much of the cannabinoid exists as THCA rather than Delta-9 THC.
Unlike Delta-9 THC, THCA itself is generally considered non-intoxicating in its raw form because it interacts differently with the body's endocannabinoid system.
When THCA is exposed to heat—through smoking, vaping, or other forms of heating—it undergoes a natural process called decarboxylation, converting much of the THCA into Delta-9 THC.
This natural conversion is why many hemp flower and pre-roll products contain high levels of THCA while remaining compliant with applicable hemp regulations prior to use.
Federal Compliance
The 2018 Farm Bill legalized hemp and hemp-derived cannabinoids provided the plant and finished product meet the federal definition of hemp, including containing no more than 0.3% Delta-9 THC by dry weight. Why Lab Testing Matters
Independent third-party laboratory testing is one of the most important tools for verifying the quality, safety, and cannabinoid content of hemp-derived products.
Every batch should be tested to confirm:
- Cannabinoid profile
- Delta-9 THC concentration
- Compliance with federal hemp standards
- Screening for contaminants such as pesticides, heavy metals, residual solvents, and microbial impurities (where applicable)

State Regulations
While certain hemp-derived products may meet federal standards, individual states may impose additional restrictions on products containing cannabinoids such as Delta-9 THC or THCA. As a result, product availability and shipping eligibility can vary depending on state law.
